Colorado County Court Information
The judicial system in Colorado is multi-layered. The Colorado Supreme Court was established in 1876. The Colorado Court of Appeals hears appeals from the District Courts. The District Courts are the trial courts of general jurisdiction in Colorado, and there are 23 judicial districts. Colorado County Courts have limited jurisdiction and hear cases involving misdemeanors, preliminary hears for felony cases, small claims cases, and civil cases under $25,000. There are also municipal courts that hear violations of city/town ordinances.

County Clerk
The Clerk and Recorder is an elected position in Colorado, and the Clerk has many important duties. The Clerk is the chief election official and maintains voter registration records. They also act as an agent for titling motor vehicles and issuing licenses.
The Clerk collects taxes and fees for motor vehicles, and issues marriage licenses and certificates. As recorder, they also manage all property records. The County Clerk also has the role of Clerk of Probate Court.
Clerk of Courts
The Clerk of Court manages all things related to the local courts. This includes overseeing the court dockets, maintaining case files, and managing all court records. The Clerk of Court also collects fees and fines ordered by the court and disperses that money as the court orders.
The Clerk of Court may also assist with jury management and schedules court hearings. They also administer oaths to witnesses who are testifying. This is an elected position.
United States District Court
The United States District Courts are used for federal cases, both civil and criminal. Federal District Judges are appointed by the President, with the Senate’s approval.
There is a single District of Colorado for the United States District Court. There are five locations of the United States District Court throughout the state of Colorado.
Hon. Philip A. Brimmer is the Chief United States District Judge for the District of Colorado. Jeffrey P. Colwell Esq. is the Clerk of Court.
Supreme Court
The state Supreme Court is the highest state court. This court hears appeals from the Colorado Court of Appeals. It also corrects errors made by lower Colorado district courts and interprets laws. The state Supreme Court can determine the constitutionality of state laws, too.
Colorado Supreme Court Justices are initially appointed by the governor to a 2-year term. After the two years, the justice must run for re-election, and elected terms are 10 years. The governor may appoint a Justice if there is a vacancy before a term ends. Justices must be licensed attorneys in Colorado with at least 5 years of experience in the state.
District Court
There are 23 Judicial Districts in Colorado. County and district courts are combined into a single location. Municipal courts for several cities and towns are also included, but those are strictly for town ordinances and have no other jurisdiction.
District Courts handle criminal felony cases, juvenile and probate matters, and civil cases in any monetary amount. They also hear cases involving domestic violence and mental health. The District Courts also hear appeals from the Colorado County Courts.
County Courts
County Courts handle the more minor cases, including traffic violations, misdemeanors, and civil actions that are no more than $25,000. This includes Small Claims Court, which handles cases involving up to $7,500. Cases heard in Colorado County Court may or may not involve a jury trial.
Civil Court
Civil cases are those that are not criminal in nature and usually involve a financial or property dispute between two people. For example, personal injury lawsuits, disputes over ownership or money, and malpractice cases are heard in Civil Court.
Colorado county court judges hear cases that involve up to $25,000. Small Claims Court involves cases up to $7,500. District court judges can hear civil cases of any monetary amount.
Criminal Court
Criminal court judges hear cases involving criminal offenses. County court judges hear cases involving traffic violations and misdemeanors, while district court judges handle felony cases.
Family Court
Family court judges hear cases involving divorce, custody, and separation. Juvenile Court is part of Family Court, as well. For example, paternity tests, adoptions, child support, dependency, and delinquency cases are heard here.
Probate Court
District court judges hear probate cases. Probate Court includes the administration and execution of estates, guardianship and conservatorship, and mental health cases. Probate Court also hears cases involving trusts.
Drug Court
Drug Court is a specialized program for offenders who have issues with substance abuse. This program offers long-term treatment, along with assistance with education, jobs, and housing. Random drug and alcohol testing are used, and the program is designed to be less adversarial than the traditional judicial process. This program is at least 6 months long.
There are Drug Court programs in at least 30 of the counties in Colorado.
Veterans Court
Veterans Court is one example of a problem-solving court. This program is designed to help veterans with substance abuse and/or mental health conditions. Under court supervision, veterans are offered tools, treatment, and assistance to succeed. This program lasts 12-18 months.
Eleven counties offer Veterans Court Treatment programs.
Magistrates
Colorado allows magistrate judges to hear some cases, particularly in Colorado County Court. Colorado requires that a magistrate be a practicing lawyer with at least 5 years experience and must be licensed in the state.
